OMAN LABOUR LAW RULES FOR NOC

NOC No Objection Certificate is widely discussed topic in Oman, NOC in is introduced in Passport and Residence Act, of Oman from year 2014 before that those employee who leave oman and want to come back then they must have to wait for 2 years but now those employee who take NOC from their previous employer can be able to come again without waiting for 2 years.

Well the wait of NOC look like it is over but people still waiting for two years. Why? It is due to NOC, employees who run away from jobs usually without informing employer don’t get NOC and hence they were banned to come again. Many Oman expats complaint about exploitation due to NOC, many employee when didn’t find the job suitable for them try to switch job but NOC is a main hurdle between changing the job. Well there are many stories you heard for expatriates related to their job changing and NOC but today we discussed what oman labour laws Passport and Residence Act, said about NOC.

The NOC is defined in Passport and Residence Act, 1995 and introduced in may 2014. The provisions that were related to NOC  are termination and resignation laws which were defined in OMAN labour laws.

The Main Article which deals with NOC is Article 11, Passport and Residence Act According to  which

“Any expatriate worker not be issued with Work permit if he has previously worked in Sultanate until waits for 2 years but those who were issued with No Objection Certificate.”

Before 2014 this rule is really relaxed by ROP and many expatriate came in Oman who previously worked here.

Many private companies happy to see the that rule are tighten again according to them it will boost the overall performance of Private Sector..

Business community welcome the decision of implementing ban on employees for 2 years those who don’t have NOC.

NOC OMAN ONLY BE LIFTED UNTIL OMAN ECONOMY IMPROVES

    I really pray that in proper discussion the NOC will come out with good solution for both worker and employers. I agree to implement NOC for those who doesn’t finish thier 2 year contract,so that the expat will not abuse using the rules of NOC. For those who finish thier contract i dont think they still need the NOC…coz for that reason the employer are abusing most of the rule of Banning them to find more good jobs that suits them. Like me i had more good opportunity if my boss just let me go and give me NOC..coz i already finish my contract. I was really force to renew coz i still have my obligation to my family..Its really hard for us who finished the contract but still we need to ask and beg for us to let go to find more good jobs…just think of it….if the worker are satisfied with thier salary and with there boss…no one will think to find new job…they will stay as long as you need them. So i hope that sooner it will come out with good results that both party will be beneficial and the NOC will be needed only for those unfinished thier contact. Thanks hope that my opinion will be counted. …

      OMANI GOV AT LEAST MAKE SOME OTHER SMOTHER RULES IN ALTERNATIVE OF NOC SO THAT EXPATS WHO FINISHED THEIR CONTRACT ALREADY NOT FACES SUCH KIND OF EXPLOITATION FROM HIS EMPLOYER

      Well NOC rule is still not removed but It is hope that when oman announced new labour laws it will be removed or made flexible

    Appreciate revisit of labour law and NOC. Requirement of NOC after 2 years of mandatory term should be lifted.

    When I have heard the news after two years finished will not require noc I am wearing for finished my job content and I was informed ny sponser and I wanted noc. Sponser also give me assurance give me noc but finally he didn’t give me noc he only cancel me. Noc good for sponser and businessman is not good for employees. Every sponser is not same most of the sponser good. But many sponser miss use noc. I request government noc paper must have to government hand both party collect noc form rop by giving some fee. Both party have to obey the rop decision. If noc under control sponser it Will be miss use and employees will not get right justice.

    is ok to put restrictions on the NOC? like you are banning other companies which you are not allowed to apply?
