Overtime Calculation in Oman – Labour Laws in Oman

Every private-sector employee is hired according to the labour law Decree No. 35/2003 of Oman, every aspect of labour rights related to the contract, Salaries, leaves, overtime, end of service, were defined in the document. The overtime rate is fixed in labour laws, employees can get overtime against the work done after the regular hours of duty. Oman Overtime laws were defined in article no 70 to 72. 

Minimum overtime is 2 hours while the maximum can be 9 hours, overtime also depends upon professions, some professionals are not given with overtime such as managerial positions, Assistants, Supervisory jobs, Senior positions, head of the department etc.

While those who were working at Ports, Airports, vessels, ships, aircraft can get allowance instead of overtime after approval from the ministry of labour.

The regular working hours according to Article no.68 is 8 hour daily and 48 hours weekly plus 1 hour break for each day. After that hours if employee works than that time is considered as overtime. Security guards and hotel employee might work for more than 12 hours so all of that hours above 8 hours were considered as Overtime and must be added in Salary. Breaks, meals and resting are not considered in overtime. Let’s see how overtime is calculated according to specific Articles.

Article No 70: Regular Overtime at Daytime

Overtime must be an increase of 25% of employee gross salary.

Examples:

If any employee has gross salary of 600 OMR than see how much he should be paid one hour of overtime.

Gross (total) Salary: 600OMR

Daily Salary= 600 x 12/365 = 19.72 per day

Per Hour Salary= 19.72/8 = 2.46 Omr

Total Overtime = Total No. of Overtime hours x per hour salary x 1.25

So if employee works for 3  hours Overtime;

3 x 2.46  x  1.25 = 9.225 OMR per hour overtime

Article 73: Night Shift

If employer want his employee to do overtime at night shift in between  9.00 PM to 4.00 AM than he must paid him, increase rate of 50% of his salary in overtime.

Using Above Example:

Total Overtime = Total No. of Overtime hours x per hour salary x 1.25

So if employee works for 2 hours than;

2 x 1.23 x  1.5 = 11.07 OMR
